{"id":1476,"date":"2025-09-01T02:41:17","date_gmt":"2025-09-01T08:41:17","guid":{"rendered":"https:\/\/somos-hermanos.mx\/?p=1476"},"modified":"2025-09-02T13:14:31","modified_gmt":"2025-09-02T19:14:31","slug":"la-mediacion-es-justicia","status":"publish","type":"post","link":"https:\/\/somos-hermanos.mx\/index.php\/2025\/09\/01\/la-mediacion-es-justicia\/","title":{"rendered":"La Mediaci\u00f3n es justicia"},"content":{"rendered":"<p>Este verano, me encontr\u00e9, en mi curso de actualizaci\u00f3n teol\u00f3gica anual, a personalidades del mundo hispanohablante que investigan sobre los derechos humanos de la mujer ind\u00edgena, la migraci\u00f3n ilegal, <strong>la Mediaci\u00f3n como justicia alternativa y la \u00e9tica del acuerdo, entre otras. <\/strong>Ahora pretendo tan solo comentar lo mucho que aprend\u00ed de ellas y que hoy inspiran esta colaboraci\u00f3n.<\/p>\n<p>La Dra. Ma. de las Mercedes Rosa Rodr\u00edguez gan\u00f3 mi atenci\u00f3n enseguida al encontrar m\u00e1s puntos de contacto al ser las dos abogadas. Est\u00e1 profesional que visita M\u00e9xico por tercera ocasi\u00f3n, para compartir sus conocimientos y aprender de nuestro pa\u00eds, tiene el doctorado en La mediaci\u00f3n es justicia, fundamentos filos\u00f3ficos y. Nuevas metodolog\u00edas: el enfoque \u201cpersonalista &#8211;\u00a0 deliberativo\u201d, de la <strong>Universidad Complutense de Madrid. Facultad de Derecho. <\/strong><\/p>\n<p><strong>La \u00e9tica del acuerdo es tambi\u00e9n tema de su investigaci\u00f3n. <\/strong><\/p>\n<p>Es La Mediaci\u00f3n como forma de justicia alternativa la que me interesa difundir ahora, precisamente cuando ha desaparecido el Poder Judicial en M\u00e9xico y lo sustituye otro poder que a\u00fan veremos c\u00f3mo se comporta.<\/p>\n<p><strong>Cu\u00e1ntos juicios desgastantes emocional y econ\u00f3micamente se podr\u00edan evitar si recurrimos a la Mediaci\u00f3n. <\/strong>Miles, muchos, pero, hemos de reconocer que a\u00fan nos faltan muchos profesionales capacitados en este arte de la mediaci\u00f3n.<\/p>\n<p>Tan s\u00f3lo como muestra del acervo de esta tesis doctoral en menci\u00f3n, apunto que en sus conclusiones finales toca los siguientes temas: Teor\u00eda de la mediaci\u00f3n, una nueva definici\u00f3n. La mediaci\u00f3n es un espacio de justicia, la naturaleza procedimental de la mediaci\u00f3n, la mediaci\u00f3n es justicia procedimental y deliberativa, la mediaci\u00f3n es un \u00e1mbito relacional dial\u00f3gico-dial\u00e9ctico y se\u00f1ala la propuesta de nueva definici\u00f3n de mediaci\u00f3n.<\/p>\n<p>Para quienes estamos interesados en que la justicia llegue a todos y que esta es \u201cdar a cada quien lo suyo\u201d, la lectura de este texto doctoral es obligada.
